Mum to sue over toddler's sunburn

A Queensland mother is planning to sue a childcare centre after her 16-month-old child suffered second-degree burns.

News Limited has reported the toddler sustained sunburn which, according to his mother, developed into blisters the morning after his stay at the Jumping Beans Children's Community Child Care in Kingaroy.

Michelle Murton said her son was "as red as a beetroot" when she collected him at 4pm Friday, October 23.

"I've never seen sunburn like it before," she was quoted as saying. "He was so red it was almost purple. For him to be burnt this bad, he must have been outside in the sun most of the day."

Ms Murton took the fair-skinned toddler to the Kingaroy Hospital emergency ward where he was treated for sunburn and given painkillers.

"Everyone at the hospital was amazed at his burns," she said. "They all came to look at him."

Ms Murton told News Limited she had contacted solicitors about seeking compensation for her son's pain and suffering.

"I just want them to recognise that they are responsible instead of denying they did anything wrong," she said.

Jumping Beans owner and manager Bevan Pearson maintains safety procedures had been followed on the day, saying all children had sunscreen applied, wore hats and spent rest and meal times in the shade.

"All the children played in the water and of 39 children on the day he was the only one who had sunburn," he told News Limited.

Maybe their safety procedures need to be upgraded to cover all children - and common sense put into practice, too.   I wonder if the adults stayed in the sun for as long?

If she does she want to hope she gets enough to buy a daycare centre because that would probably be the only way she will ever be able to send her children to a daycare centre again. The daycare may have been in the wrong but they are human.

They obviously forgot to suncream him - easy to miss one - but they have a duty of care to make sure they are all covered...
Hopefully others will read this and be more careful of those in their care.

she also didnt adequetly dress her child, no long sleeve rashie.He was wearing sunscreen, it just wore off.

Maybe they should look into the sunscreen they use. I am fair skinned so have to have the highest SP factor for my skin. I think they have been negligent as the toddler was only 16months old and if they had been playing in water then of course the sunscreen would come off and they would need to keep putting it on.

Shes a suer, she went to the news and the solicitors pretty quick.
Did the hospital call them second degree burns or sunburnt?

My childs pre school has a policy no hat no outside play, they make sure sunscreens on them.
You would think they would notice if one child was really sunburnt  and taken him indoors.

This is sad, unfortunate case that has happened, I hope this wont mean pre schools/day school etc will
stop kids playing outside, or charge higher fees to cover additional insurance/ligitation costs that could result
with the insurance companies.
I feel sorry for the toddler, it does look like he got sunburnt, but lets just see how much this mum sues for..
