Purchaser
Eligibility
Requirements
You
must
meet
all
the
following
requirements
to
be
eligible
to
claim
under
the
Buyer
Shield:
- You
are,
and
were
at
the
time
of
placing
your
successful
bid/purchase
for
the
Eligible
Good
an
Australian
resident.
- The
seller
of
the
Eligible
Good
is
an
Eligible
Seller
(see
"What
is
an
Eligible
Seller"
for
more
details).
- You
have
paid
for
the
Eligible
Good
using
a
credit
card,
Paymate,
PayPal
or
such
other
method
designated
by
OZtion
from
time
to
time
as
being
a
"safe
payment
option"
as
outlined
in
these
Terms
and
Conditions.
You
are
required
to
provide
us
with
a
proof
of
payment
to
our
satisfaction.
- You
requested
the
seller
to
send
the
Eligible
Good
to
you
by
a
"Proof
of
Delivery"
postage
method
(registered
post,
insured
post
or
proof
of
delivery
courier)
and
you
paid
for
such
delivery
method
(you
are
required
to
provide
us
with
a
proof
of
payment
for
such
delivery
to
our
satisfaction).
- You
have
not
received
(in
whole
or
part)
the
Eligible
Good.
- The
seller
has
refused
or
failed
to
refund
the
sale
price
for
the
Eligible
Good
or
the
seller
is
not
contactable
(i.e.
emails
are
not
returned,
telephone
calls
not
answered
etc).
- You
have
in
good
faith
utilised
OZtion's
Buyer
Protection
Programs
process
detailed
in
the
"Buyer
Protection
Programs"
page
on
OZtion's
website
to
try
and
resolve
the
matter
with
the
seller.
- You
have
filed
a
"Report
Item
Not
Received"
dispute
with
OZtion
and
have
escalated
the
dispute
to
a
claim
under
the
Buyer
Shield
between
14
to
28
days
after
the
dispute
was
first
filed.
- After
completing
the
"Report
Item
Not
Received"
dispute,
you
have
then
used
all
reasonable
endeavours
to
obtain
a
refund
of
your
payment
via
alternate
means
including
credit
card
charge
back
with
your
credit
card
provider,
safe
payment
compensation
(eg.
PayPal
or
Paymate)
to
OZtion's
reasonable
satisfaction.
All
such
alternate
recovery
methods
must
be
exhausted
prior
to
lodging
a
claim
under
the
Buyer
Shield.
- You
have
provided
OZtion
with
a
police
report
evidencing
that
the
transaction
has
been
reported
as
fraudulent.
- You
have
not
made
any
previous
claims
under
the
Buyer
Shield
in
relation
to
the
seller.
- You
have
not
claimed
(successful
or
not)
under
the
Buyer
Shield
within
the
preceding
12
months
of
the
date
of
auction
close.
- You
are
not
and
have
not
since
the
time
of
placing
your
successful
bid
for
the
Eligible
Good,
been
in
breach
of
OZtion's
User
Agreement.
- You
have
not:
(a)
recovered
part
or
all
of
the
purchase
price
from
the
seller
or
another
source;
and/or
(b)
reached
a
settlement
of
the
matter
with
the
seller.
What
is
an
Eligible
Seller?
To
qualify
as
an
Eligible
Seller:
- the
seller
must
be
located
within
Australia;
- the
seller
must
be
Phone
Verified
or
Australia
Post
Verified
with
a
98%
or
more
unique
satisfied
buyers
rating
and
must
not
be
currently
involved
in
any
"Item
Not
Received"
disputes;
- the
payment
methods
listed
by
the
seller
on
the
listing
for
the
Eligible
Good
allowed
for
payment
by
credit
card,
Paymate,
PayPal
or
such
other
method
designated
by
OZtion
from
time
to
time
as
being
a
"safe
payment
option";
and
- the
seller's
delivery
method
offered
"Proof
of
Delivery";
postage
on
the
listing,
either
via
postage
by
registered/insured
post
or
proof
of
delivery
courier
within
Australia.
How
much
can
I
claim?
The
amount
you
can
claim
is
dependant
on
the
Eligible
Seller’s
rating
and
verification
level
at
the
time
of
the
purchase
(see
table
below)
of
the
Eligible
Goods.
You
may
claim
an
amount
paid
by
you
of
up
to
$400
or
the
auction's
sold
price
at
the
auction's
close,
whichever
is
the
lesser.

How
do
I
claim?
- You
must
complete
OZtion's
Australia
Post
Verification
prior
to
lodging
a
claim.
- You
must
correctly
complete
the
Buyer
Shield
Claim
Form
("Claim
Form")
and
lodge
it
with
OZtion
(together
with
all
documentation
requested
in
the
Claim
Form)
within
90
days
of
the
date
of
close
of
bidding
of
the
auction
for
the
Eligible
Good
in
respect
of
which
you
wish
to
make
a
claim.
- You
must
comply
with
OZtion's
queries
and
requests
in
relation
to
your
claim
within
the
time
stipulated
by
OZtion.
You
will
forfeit
your
ability
to
claim
under
the
Buyer
Shield
if
you
fail
to
comply
with
a
request
made
by
us
within
the
time
specified
in
our
request.
- We
will
endeavour
though
are
not
bound,
to
assess
your
claim
and
either
accept
or
reject
it
within
45
days
of
receiving
your
correctly
completed
Buyer
Shield
Claim
Form
and
accompanying
documentation.
What
are
Eligible
Goods?
Items
which
have
been
sold
on
the
OZtion
website
except
for:
(a)
intangible
goods
or
goods
that
were
not
and/or
cannot
be
physically
shipped
(e.g.
services,
emailed
goods,
warranties,
business
names,
electronically/digitally
stored
content,
trade
marks,
intellectual
property
etc.);
(b)
motor
vehicles;
(c)
tickets
(e.g.
tickets
to
concerts,
football
matches,
exhibitions
etc);
(d)
goods
or
services
contained
in
OZtion's
Prohibited
Item
List;
and
(e)
goods
that
are
listed
on
the
relevant
auction
page
as
having
a
"Ship
From"
location
outside
Australia.
Payment
under
Buyer
Shield
OZtion
will
pay
your
claim
within
28
days
of
notifying
you
that
your
claim
has
been
approved.
Exclusions
and
Limitations
You
may
only
make
one
claim
per
auction
listing.
You
may
not
make
more
than
one
claim
(successful
or
not)
within
any
12
month
period.
You
may
not
make
a
claim
if
you
have
been
successful
in
obtaining
payment/reimbursement
from
another
source
(eg.
credit
card
charge
back).
OZtion's
maximum
liability
in
relation
to
a
successful
claim
under
Buyer
Shield
is
the
sold
price
at
the
close
of
auction/purchase
for
the
Eligible
Good
or
$400,
whichever
is
the
lesser.
You
are
ineligible
to
claim
under
the
Buyer
Shield
if:
(a)
you
paid
an
amount
to
the
seller
(excluding
postage)
in
excess
of
the
auction's
sold
price;
and/or
(b)
you
purchased
the
Eligible
Good
outside
of
the
auction
(eg.
by
negotiation
prior
to
auction
close).
Completion
All
decisions
of
OZtion
are
final.
Once
decided
by
OZtion,
a
claim
under
the
Buyer
Shield
cannot
be
reopened
without
OZtion's
written
consent.
The
decision
to
make
a
payment
under
the
Buyer
Shield
is
at
OZtion's
sole
discretion.
The
OZtion
Buyer
Shield
("Buyer
Shield")
is
subject
to
change
without
notice.
This
policy
is
effective
5th
October
2007.

Buyer
Shield
is
